These terms and conditions of sale govern product sales concluded between Jean-Paul Dana, Independent Herbalife Distributor (“the Seller”), and any private individual, acting as a consumer, making a purchase (“the Customer”).
The products offered are Herbalife nutrition and wellbeing products, resold by the Seller in their capacity as an independent distributor. Photographs and descriptions are provided for guidance only.
Prices are shown in euros, all taxes included. VAT not applicable, art. 293 B of the French Tax Code (basic exemption). The applicable price is the one confirmed by the Seller at the time of reservation. For customers outside the euro area, the exact price is confirmed in the customer's currency before payment. Any delivery charges are stated before payment.
The order works as follows: the Customer reserves a pack via the site form (without payment); the Seller confirms availability and price; the Seller sends a secure payment link; the sale is concluded upon receipt of payment.
Payment is made via the secure link sent by the Seller, through a payment provider. The Seller never has access to the Customer's banking details.
Delivery is made to the address provided by the Customer. Delivery times are indicative and cannot engage the Seller's liability in the event of a reasonable delay.
In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal, without needing to give a reason. To do so, they inform the Seller by email at capvitaliteenergie@gmail.com. Products must be returned unopened and unsealed. In accordance with the law, the right of withdrawal does not apply to sealed products that cannot be returned for hygiene reasons and that have been unsealed after delivery.
The Customer benefits from the legal warranty of conformity (art. L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (art. 1641 et seq. of the French Civil Code).
Any complaint can be sent to capvitaliteenergie@gmail.com. The Seller operates as an Independent Home Sales Representative (VDI) within direct selling, an activity governed by the French Direct Selling Federation (FVD). In accordance with articles L.612-1 et seq. of the French Consumer Code, in the event of a dispute not resolved amicably, the Customer may refer the matter free of charge to the competent consumer mediator:

These terms are governed by French law. Failing an amicable resolution, any dispute falls under the jurisdiction of the competent French courts.
